What happens after an arrest in Spartanburg County

  1. Arrest and booking. Spartanburg Police, the Sheriff's Office, town police departments, and the Highway Patrol book people at the Spartanburg County Detention Center, 950 California Avenue. The Sheriff's Office posts a bookings search.
  2. Bond hearing. State law requires a bond hearing within 24 hours of arrest for a bailable offense (S.C. Code § 22-5-510). The Sheriff's Office says magistrates usually hold bond hearings at the detention center every day at 11 a.m., 6 p.m., 9 p.m., and midnight, and after that as needed. Some serious charges can only have bond set by a circuit judge.
  3. Bond is set. The law starts from release on a personal recognizance bond, a written promise to appear. The judge can instead require a surety bond and add conditions (S.C. Code § 17-15-10). See how bail works.
  4. Posting bond. Pay cash, deposit up to 10% in cash if the judge allows it, use a property owner as an accommodation surety, or hire a licensed bondsman. Release must happen within four hours after the bond is delivered to the jail.
  5. Court dates. The first court date is on the bond paperwork or ticket. Missing any court date can lead to a bench warrant and forfeiture of the bond. See missed court dates.
  6. End of the case. When the case ends, the bond ends. A bondsman must return collateral within ten days after liability on the bond ends, unless a bench warrant has been issued (S.C. Code § 38-53-170). See getting collateral back.

For a DUI arrest, the DMV deadline is separate from bond: our sister site SpartanburgDUI.com explains the 30-day hearing request.

Bail and bond in one paragraph

South Carolina law starts from release on your own recognizance, with no money up front, unless the judge decides more is needed to make sure the person comes back to court or to protect the public (S.C. Code § 17-15-10). If a surety bond is set, it can be paid in full in cash, partly in cash if the judge allows, signed by a property owner as an accommodation bondsman, or posted by a licensed professional bondsman for a premium that state law caps at 15 percent of the bond (S.C. Code § 38-53-170). The premium is not refunded, even if the charge is dropped. Laws and fees can change. More in the guides, and licensed companies in the directory.
